1. Who we are and scope of this Cookie Policy
1.1 This Cookie Policy explains how Dawa Exec Ltd ("Dawa", "we", "us" or "our") uses cookies and other technologies that store information on, or access information from, a user's device when they use our websites, booking pages and portals.
1.2 This Policy applies to online services operated by or for Dawa Exec Ltd, including services marketed under Dawa Exec, Dawa Exec Chauffeurs and Dawa Cars where they use the same Dawa legal framework.
1.3 This Policy should be read with the Dawa Exec Ltd Privacy Policy, which explains how personal data is used more generally.
2. What cookies and storage/access technologies are
2.1 Cookies are small text files that a website can place on a browser or device. They can help a website recognise a device, maintain a session, remember settings or support other functions.
2.2 The legal rules are not limited to traditional cookies. Similar storage and access technologies can include web storage, scripts, tags, pixels and other technologies that store information on or access information from a user's device.
2.3 Where information collected through these technologies is personal data, the UK GDPR and Data Protection Act 2018 may also apply.
3. How we apply the PECR rules
3.1 Dawa will provide clear information about the purposes for which storage and access technologies are used.
3.2 Where the law requires consent, Dawa will not use the relevant technology for that purpose until valid consent has been obtained.
3.3 Certain purposes can fall within specific exceptions under the Privacy and Electronic Communications Regulations (PECR), including technologies that are strictly necessary to provide a requested service and, subject to their legal conditions, certain statistical and appearance/functionality purposes.
3.4 Where Dawa relies on the statistical-purpose or appearance exception, users will be given clear information and a simple means of objecting free of charge. If the conditions for an exception are not satisfied, Dawa will obtain consent where required.
3.5 An exception is purpose-specific. A technology used for an exempt purpose will not be treated as exempt if the same storage or access is also used for a non-exempt purpose such as advertising or individual profiling.
4. Strictly necessary technologies
4.1 Strictly necessary technologies may be used where they are essential to provide an online service that the user has requested.
4.2 Examples can include technologies needed for login and authentication, account security, fraud prevention, session management, booking or checkout functionality, payment hand-off, load balancing, security controls and remembering a user's privacy choices.
4.3 Where the strictly necessary exception applies, these technologies may operate without consent because the requested service could not properly be provided without them.
4.4 Dawa will not label a technology as strictly necessary merely because it is convenient or commercially useful.
5. Statistical and analytics technologies
5.1 Dawa may use statistical or analytics technologies to understand how its websites or portals are used and to improve the service.
5.2 Where Dawa relies on the PECR statistical-purpose exception, the sole purpose of the storage or access will be to collect statistical information about use of the service or website with a view to improving it.
5.3 Where that exception is relied on, the resulting information will be used as aggregate statistical information rather than to identify, track, profile or make decisions about individual users, and users will have a simple and free means of objecting.
5.4 If analytics technology is used for additional purposes, such as advertising measurement, individual tracking, profiling or cross-service monitoring, the statistical-purpose exception will not be relied on for those purposes and consent will be obtained where required.
6. Preference, functionality and appearance technologies
6.1 Dawa may use technologies that remember a user's choices or adapt how the online service appears or functions, for example language, interface or display preferences.
6.2 Where Dawa relies on the PECR appearance exception, the technology will be used only for the permitted appearance or functionality purpose and the user will be given a simple and free means of objecting.
6.3 Technologies that use preferences or browsing behaviour to select advertising, promotional content or personalised marketing will not be treated as falling within the appearance exception.
7. Marketing and advertising technologies
7.1 Dawa will only use storage and access technologies for marketing, advertising, remarketing, behavioural profiling or advertising measurement where the required consent has been obtained.
7.2 Marketing technologies will not be treated as strictly necessary merely because they help Dawa measure or improve advertising performance.
7.3 If Dawa does not use marketing or advertising technologies, this Policy does not imply that such technologies are active.
8. Third-party technologies and embedded services
8.1 Some website or portal functions may involve third-party services, for example payment processing, maps, security, hosting, communications or other embedded functionality.
8.2 Where a third party stores or accesses information on a user's device through a Dawa service, Dawa will assess the purpose and apply the appropriate PECR and data-protection requirements.
8.3 Where a third-party analytics provider is used under the statistical-purpose exception, Dawa will ensure the arrangement is limited to assisting Dawa to produce statistical information for improving the relevant service or website and does not permit the provider to use that information for unrelated purposes.
8.4 Dawa will not name a cookie or third-party provider in the published cookie information unless it has been verified as active or applicable to the relevant Dawa online service.
9. Cookie preferences, consent and objections
9.1 Where consent is required, the website or portal will provide a mechanism that allows users to make a genuine choice before the relevant technology is used.
9.2 Users will be able to change or withdraw consent for consent-based technologies through the available cookie or privacy controls.
9.3 Where Dawa relies on the statistical-purpose or appearance exception, users will be given a simple means of objecting free of charge. Once a user objects, Dawa will stop using the relevant technology for that exempt purpose on that device or browser as required by law.
9.4 Rejecting or objecting to optional technologies will not prevent the use of technologies that remain strictly necessary to provide a service requested by the user.
9.5 Dawa may ask for a fresh choice where the technologies, purposes or legal position materially change.
10. Current cookie / technology register
10.1 Dawa periodically verifies the technologies actually active on its live websites, booking pages and portals and updates its live cookie or privacy controls where required.
10.2 The live cookie-preference tool, cookie register or equivalent information made available with the website will identify the active technologies in sufficient detail, including their purpose, category, provider where relevant and lifespan or duration where applicable.
10.3 Dawa does not publish cookie names, providers or durations unless they have been verified for the relevant live service. The live cookie-preference tool, cookie register or equivalent control should be treated as the current operational source for those details.
11. Browser and device controls
11.1 Most browsers and devices provide controls that allow users to block or delete cookies or other stored information.
11.2 Browser settings are separate from Dawa's own consent and objection controls. Where the law requires Dawa to provide a consent or objection mechanism, Dawa will not rely solely on the user changing browser settings.
11.3 Blocking strictly necessary technologies may prevent parts of the booking, account, security or payment functionality from working correctly.
12. Lifespans and retention
12.1 Cookies and similar technologies may be session-based, meaning they expire when a browser session ends, or persistent, meaning they remain for a defined period unless deleted earlier.
12.2 Dawa will set or accept lifespans that are appropriate for the relevant purpose and will not retain device-level information for longer than necessary for that purpose.
12.3 Where Dawa relies on the statistical-purpose exception, individual-level information will be retained only for as long as needed to create the permitted aggregate statistical information.
12.4 The applicable live cookie register or preference tool will provide further lifespan information for active technologies where relevant.
13. Personal data and international processing
13.1 Where information collected through cookies or similar technologies is personal data, Dawa will process it in accordance with the Dawa Exec Ltd Privacy Policy and applicable UK data protection law.
13.2 Where a relevant service provider processes personal data outside the UK, Dawa will apply an appropriate lawful international-transfer safeguard where required.
14. Changes to this Cookie Policy
14.1 Dawa may update this Policy when its websites, portals, technologies, suppliers or legal obligations change.
14.2 The current published version will show its version number and effective date. Material changes to consent, objection or tracking practices will be reflected in the relevant user controls where required.
